Fee Structure & Procedure for Seeking Information under DRTI Act, 2001
The Delhi Right to Information Rules, 2001 were notified vide Notification No.F.17/3/2001/AR, on 19.10.2001 for the smooth implementation of the Delhi Right to Information Act, 2001 (as amended vide Notification No.F.17/11/03/AR/2330-2629, dated the 28.01.2005). It prescribes the fee and procedure for filing DRTI applications for seeking information from various public authorities of Government of NCT of Delhi, excluding Delhi Police, Law & Order and Land which are not covered under this Act.
Application for seeking information: As per these rules any person seeking information under the DRTI Act has to make an application in Form ‘A’ to the Competent Authority of the organization concerned and deposit it within the concerned organization itself. The Competent Authority shall duly acknowledge the application as provided in Form ‘A’. Request for seeking information can also be made through electronic form.
The applicant has to deposit application fees in cash or in the form of affixing non- judicial stamp on the application or postal order or Bank draft in the name of “Govt. of NCT of Delhi” as per DRTI Rule 8 with the authorized person.
A person who makes a
request through electronic form shall ensure that the requisite fee is
deposited in cash or in form of postal order or Bank draft in the name of
“Govt. of NCT of Delhi” as per DRTI
Rule 8 with the authorized person within seven days of his request sent through
electronic form, failing which his application shall be treated as withdrawn by
the applicant.

Disposal of application by the competent authority: The following modes have been prescribed for disposal of DRTI application under DRTI Rules, 2001:
Return of unconcerned DRTI applications: In case the requested information does not fall within the jurisdiction of the Competent Authority, it shall return the DRTI application to the applicant in Form ‘B’ as soon as practicable, normally within fifteen days and in any case within thirty days of the receipt of the application. The applicant shall be advised, wherever possible, about the competent authority to whom the DRTI application should be made. However, the DRTI application fee deposited in such cases shall not be refunded.
Rejection of DRTI application: In case the requested information falls within the Competent Authority's jurisdiction but falls in one or more of the categories of restrictions listed in section 6 of the DRTI Act i.e. where the information cannot be supplied, then the competent authority, on being satisfied, will issue the rejection order in Form ‘C’. It shall be done as soon as practicable, normally within fifteen days and in any case, within thirty days from the date of the receipt of the application.
Provision of information on DRTI application: In case the requested information falls within the Competent Authority's jurisdiction but is not hit by one or more of the categories listed in section 6 of the DRTI Act, then the competent authority, on being so satisfied, shall supply the information to the applicant in Form ‘D’, falling within his jurisdiction.
In case, the information sought is partly outside the jurisdiction of the competent authority or partly falls in the categories listed in section-6 of the Act, then the Competent Authority shall supply only such information as is permissible under the DRTI Act and is within its own jurisdiction and reject the remaining part giving reasons thereof.
Time frame for supply of information: The information under DRTI Act shall be supplied as soon as practicable, normally within fifteen days and in any case within thirty days from the date of the receipt of the application on deposit of the balance amount, if any, to the authorized person, before collection of information.
A proper
acknowledgement shall be obtained from the applicant in token of receipt of
information.
Charging of Fee: The competent authority shall
charge the fee at the following rates, namely: -
(A) Application fees:
(a) A fee of Rs 25/- shall be charged per application for information.
(b) A fee of Rs 15/- per 15 minutes (or
fraction thereof) Inspection of documents.
(B) Other Fees:
(a) For the
information is available in the form of a priced publication- Price so fixed
(b) For other than priced
publication- Five rupees per page
(C) Fee for Appeals: The appellate authority shall charge
a fee of fifty rupees per appeal.
